DUI Penalties in the State of Florida

While not an exhaustive list, the following kinds of penalties attached to different kinds of DUI convictions. DUI arrest with minors in the vehicle or with blood alcohol levels over .20, increase the penalties listed below.

  • First-time DUI conviction: a fine between $250 and $500; jail time not more than 6 months; license revocation between 180 days and a year.
  • Second-time DUI conviction: a fine between $500 and $1,000; jail time up to 9 months; license suspension at least 5 years if convicted within 5 years of an earlier DUI conviction.
  • Third-time DUI conviction not more than 10 years after first DUI: a fine between $1,000 and $1,500; a mandatory jail sentence of at least 30 days; a minimum 10 year license revocation

Please keep in mind that the court may order repeat offenders to install an ignition interlock device at their own expense. The ignition interlock device works like a breathalyzer in measuring your blood alcohol content (BAC). When installed, a car will not start unless BAC is measured below a certain limit. These devices can be costly to install and may require a monthly monitoring charge.

When DUI Allegations must be Challenged

In cases where an officer makes an illegal car stop, administers a field sobriety test incorrectly, or uses an improperly calibrated breathalyzer, a DUI charge must be challenged. If upon reviewing the circumstances of your arrest it becomes clear that mistakes were made, our attorneys consult forensic experts and law enforcement training professionals in identifying where mistakes were made.

Since field sobriety tests are, in some respects, designed to increase failure, it's not unusual for a sober person to fail one. Likewise, breathalyzers must be properly maintained, correctly calibrated and administered in strict adherence to directions. When it becomes clear that procedural failures have occurred in the arrest of our client, we have the resources needed to expose mistakes on the part of arresting officers and defective equipment.

Don't Let a Drunk Driving Charge Ruin Your Job and Your Life

If convicted for drunk driving, your insurance will increase substantially. Additionally, if you're sentenced to jail, your employer could fire you or make it difficult for you to return to work. Afterwards, you will have a criminal conviction on your record which could impact your ability to find a job. Even if you avoid jail or avoid a lengthy sentence, a revoked license could make it difficult to go to work or take care of day to day responsibilities. If you drive for a living, even the shortest license suspension can substantially affect your bottom line.

At The Law Office of Marc Shelowitz and Andrew Coffey, we can help you avoid some or all of these difficulties. To schedule a free, confidential consultation to discuss your case, contact the DWI defense attorneys at The Law Office of Marc Shelowitz and Andrew Coffey today.
